class=\"P1\">&nbsp;<\/p><p class=\"P1\"><span>Vielfach wird f\u00e4lschlicherweise davon ausgegangen, dass die Freiz\u00fcgigkeit von Arbeit\u00adnehmern innerhalb der EU auch bedeutet, dass Arbeitssuchende aus anderen EU-L\u00e4ndern im Bedarfsfall auch hiesige Grundsicherungsleistungen in Anspruch nehmen k\u00f6nnen. Dem ist jedoch nicht so.<\/span><\/p><p class=\"P1\"><span>Es stimmt zwar: Die Charta der Grundrechte der Europ\u00e4ischen Union garantiert jedem B\u00fcrger der EU-Mitgliedsstaaten das Recht, sich in jedem EU\u2013Land niederzulassen und dort arbeiten zu d\u00fcrfen.<\/span><br\/><span>Doch Deutschland hat dieses Recht im \u201eFreiz\u00fcgigkeitsgesetz\/EU\u201c (nationales Recht) bereits deut\u00adlich eingeschr\u00e4nkt, z.B. durch die grunds\u00e4tzliche Begrenzung des Aufenthalts zur Arbeitssuche in Deutschland auf 6 Monate. <\/span><\/p><p class=\"P1\"><span>Und unterhalb dieser Schwelle gibt es eine Reihe weiterer gesetzlichen Regelungen, zum Beispiel im Sozialleistungsrecht, die die Freiz\u00fcgigkeit noch weiter beschneiden. So ist z.B. der Bezug von Grundsicherungsleistungen nach SGB II (Hartz-IV) w\u00e4hrend der Zeit der erstmaligen Arbeitssuche komplett ausgeschlossen. Faktisch stehen diese Leistungen nur denjenigen offen, die hier bereits als Arbeitnehmer oder Selbstst\u00e4ndige arbeiten (als erg\u00e4nzende Leistungen) - oder aber fr\u00fcher gearbeitet haben, und nachweislich unverschuldet arbeitslos geworden sind oder noch Kinder in der Schule\/Ausbildung haben. Wer da nicht drunter f\u00e4llt, muss schon mindestens 5 Jahren hier leben, bevor erstmals Anspr\u00fcche auf Sozialleistungen geltend gemacht werden k\u00f6nnen. Beachte: Dies sind die Bedingungen f\u00fcr B\u00fcrger aus anderen EU-L\u00e4ndern. Die Bedingungen f\u00fcr Migranten aus Nicht-EU-Staaten sind noch um ein Vielfaches strenger!<\/span><\/p><p class=\"P1\"><span>Die rechtliche Ungleichbehandlung ist politisch gewollt und dient der Abschreckung. \u201eWir sind nicht das Sozialamt f\u00fcr die ganze Welt\u201c, so Innenminister Horst Seehofer beim Aschermittwoch der CSU im Jahr 2015.
